Ukrainian IPO Appeal Board Resumes Operations
After not operating since 8 November 2022 due to the profound IPO reform in Ukraine, the Appeal Board of the Ukrainian National Office for Intellectual Property and Innovations resumed operations on 18 June 2024, after the personnel of the Appeal Board was approved by the IPO’s Order No. 93/2024.
The Appeal Board now consists of 40 IP specialists, whose assignment to different panels on the Board is being finalized. The cases referred to the Appeal Board are being assigned and their consideration is expected to begin shortly. The Appeal Board’s monthly schedule will be regularly published and updated on the IPO’s official website.
Besides considering oppositions to the IPO’s decisions regarding IP rights registration and considering applications for trademarks to be recognized as well-known in Ukraine, the Appeal Board will now also consider post-grant oppositions regarding inventions, utility models and industrial designs and hold mediations during appeals or oppositions. It is also now possible to file documents in electronic form with a qualified electronic signature through the IPO’s Information and Communication System (ICS), while the requirements for conducting a survey for a trademark to be recognized as well-known have been simplified.
