Ukraine's AMCU Fines Cosmetics Manufacturer for Copying Swiss SUN SCRIPTION Branding

On 6 August 2026, the Antimonopoly Committee of Ukraine (AMCU) ruled that an entrepreneur from the Dnipropetrovsk region, east-central Ukraine, violated Article 4 of Ukraine’s Law “On Protection Against Unfair Competition” for unlawfully using the “SUN SCRIPTION” designation – together with other verbal and figurative elements – to market a SUN SCRIPTION SPF 50” facial sunscreen.

The “SUN SCRIPTION” designation had previously been used by Swiss skincare company INSTYTUTUM AG and its Ukrainian distributor, Institute Hyalual LLC. To protect their IP rights, the companies filed an application with the AMCU, alleging unfair competition.

Following an investigation, the AMCU concluded that the entrepreneur’s copycat packaging could mislead consumers and generate an unfair competitive advantage by exploiting the established market reputation of INSTYTUTUM AG and Institute Hyalual LLC. This finding was supported by an expert IP evaluation alongside an official AMCU consumer survey.

Because the entrepreneur stopped the violation and altered the product packaging, the AMCU factored in the compliance and imposed a mitigated fine of 50,000 UAH (approximately 970 EUR).
