Kazakhstan Introduces Expedited Examination of Trademark Applications

As of 23 February 2024, the examination of trademark applications in Kazakhstan can be carried out in an accelerated procedure.

Accelerated examination includes accelerated formal examination within ten working days from the filing date (the standard term is one month) and accelerated substantive examination within three months from the filing date (the standard term is seven months).

A request for an expedited examination, along with the relevant payment confirmation, must be submitted along with the trademark application. If no payment confirmation is provided, the application is not considered filed, and the applicant is notified accordingly within five working days from the filing date.

The official fee for requesting accelerated examination for a trademark in up to 3 classes is EUR 1,627. Each additional class over 3 is charged EUR 455.

It is crucial to highlight that the request for expedited examination includes the applicant’s declaration that they are aware of the possible cancellation of the trademark registration if there is an application with convention, exhibition and/or other priority.

It is also important to note that, when the Intellectual Property Office issues an office action, expedited examination is suspended until the necessary information is received from the applicant.

Expedited examination is also suspended in the following cases:

  • If the applicant extends the deadline for providing a response to an office action;
  • During the two-month grace period for restoring the missed deadline to respond to an office action;
  • If the registration procedure is suspended because an objection was filed before the Appeals Board.
