Saudi Arabia: Monitoring Appeals After a Successful Trade Mark Opposition

A favourable trade mark opposition decision in Saudi Arabia may not necessarily signal the end of the matter, as applicants may challenge the decision before the competent court within 30 days of notification.

In practice, determining whether an appeal has been filed can be challenging for the successful opponent, as such appeals are commonly brought against the Saudi Authority for Intellectual Property (SAIP). Therefore, no court notice is issued unless the court decides to include the winning party in the proceedings, in which case they are notified of a scheduled hearing and given an opportunity to respond.

An opponent should not assume that the absence of a court notice means that no appeal has been filed, as such notifications are rarely issued automatically. While SAIP's online portal provides useful status information, it is not determinative. Following a successful opposition, an application will typically show as "rejected”. However, the status may remain unchanged even after the appeal period has expired, meaning it should not be relied upon as evidence that no appeal has been filed.

If an appeal succeeds, updates to the online status depend on the timely submission of the judgment for enforcement and the time taken by SAIP to implement the decision. Rights holders should therefore monitor the appeal deadline and the application status, and avoid treating the case as closed simply because no appeal notice has been received.
