Libya Adopts New Trademark Regulation
On 17 January 2024, Resolution No. 26 of 2024 entered into force in Libya, implementing a new executive regulation regarding Law No. 23 of 2010 on Trademarks.
The new regulation clarifies the definition of registrable trademarks and introduces a provision allowing the registration of sound marks.
The requirements for filling a trademark application now also include the following:

The applicant’s original commercial register extract, accompanied by a copy of the legal representative’s ID or passport;

Legalized power of attorney;

Legalized written undertaking ensuring conformity of goods intended for trademark registration with Libyan standard specifications;

Statement regarding the circulation of goods in Libya supported by evidence; in cases where the mark hasn’t been circulated in Libya, a statement to that effect must be provided;

Legal translation into Arabic, along with pronunciation guidance for non-Arabic marks;

Submission of an mp3 audio file in case of a sound mark.
Under the regulation, the deadline to file an opposition has been shortened from three months to 30 days from the publication date, and the deadline to file a counterstatement has been shortened from one month to 15 days from the notification date.
Additionally, the official fees for the application, publication, renewal, and registration of trademarks have been increased.
Finally, all trademark applications are published through the official website of the Ministry of Economy starting from 1 February 2024.
